Shawn Shearer brings nearly thirty years of diverse legal expertise from the big firm and corporate arena to a sophisticated private practice. His drive to learn and accept career challenges has resulted in a developing skill set rarely available to clients outside of a corporate structure or large law firm.
Mr. Shearer began his career in Phoenix, focusing on corporate finance, banking regulations and securities at the Streich Lang (now Quarles & Brady) and Bryan Cave law firms. In 1999, he moved into the corporate sector and became Associate General Counsel for the then emerging National Airlines in Las Vegas. During this time, Mr. Shearer acquired expertise in the areas of union and labor relations, equipment leasing negotiation and finance, aircraft acquisition and registration and Chapter 11 reorganization, negotiation and litigation.
In 2002 Mr. Shearer accepted a position in the Dallas area as Assistant General Counsel for AdvancePCS, now CVS Caremark. While at AdvancePCS, he practiced with an emphasis on corporate governance, Securities and Exchange Commission periodic filings and compliance, mergers and acquisitions, executive and equity compensation, and hostile takeover defense. Following the acquisition of AdvancePCS by Caremark, Mr. Shearer became Senior Counsel and Assistant Secretary for 7-Eleven, Inc. This position afforded him extensive experience in the areas of gasoline distribution, franchising, licensing, tax, environmental remediation and litigation, class action litigation, PMPA, and government investigations.
In 2013, Mr. Shearer began his private practice with the intent to translate this in-house experience into providing effective and efficient outside counsel service to both individuals and businesses. Beginning in 2017, Mr. Shearer began to focus heavily on his federal practice, and currently spends the majority of his time applying his extensive background in constitutional law representing plaintiffs in complex employment cases involving FMLA/ADA violations, sexual harassment, and civil rights violations, with an emphasis on Article I and Article II (separation of powers) Article III (political question doctrine) Fourth, Fifth, Tenth, Thirteenth and Fourteenth Amendment violations. His practice has also expanded into interstate custody disputes (UCCJEA) and Section 1983 Actions. Many clients come to Mr. Shearer reeling from previous legal over-billing and/or malpractice, and as such, he has incorporated review and auditing of other lawyer’ s billing as a cornerstone of his current practice.
Originally from West Des Moines, Iowa, Mr. Shearer received his B.S. in Economics from the University of Iowa in 1990. An accomplished debater, Shawn was awarded a full-ride scholarship in debate, and was a four-time qualifier to the National Debate Tournament. His summers were spent as an instructor at various Debate Institutes, including Dartmouth College, American University, Baylor University, Georgetown University and the University of Iowa. During his tenure in law school, he served as assistant coach for the University of Iowa Debate Team. He earned his J.D. from the University of Iowa School of Law in 1993, graduating fourth in his class. His awards include graduating with High Distinction, Order of the Coif, Second Place National Labor Law Writing Contest and Appellate Advocacy-Outstanding Advocate. He was a member of the University of Iowa Moot Court Team. Shawn currently serves on the Board of the Dallas Urban Debate Alliance, and the Dallas Volunteer Attorney Program, providing service to pro bono clients in the Dallas area.
Mr. Shearer is admitted to practice law currently in the United States Supreme Court, the United States Court of Appeals for the Second Circuit, the United States Court of Appeals for the Eighth Circuit, the State of Texas, the State of Arizona, the State of Iowa, the Federal District of Arizona, the Federal District of North Texas, the Federal District of Northern Iowa, the Federal District of Southern Iowa, the Bankruptcy Courts for the Federal Districts of Arizona and North Texas, and the United States Tax Court.
